For everyone Legal news: Full steam ahead in every sector

The industrial team has been heavily engaged in bargaining for improved conditions in TAFE, disability, and early childhood.

Due to the intransigence of TAFE employers, the AEU has obtained a protected action ballot order. Industrial action is necessary to force TAFE institutes to properly engage with the AEU’s demands for improved workload provisions and better pay. It is vital that non-members join so they can take part. Industrial officers have also been involved in bargaining in dual-sector TAFEs.

In disability, we are running a supported bargaining application in the Fair Work Commission for members employed under expired ‘zombie’ agreements. We have filed submissions, and we are currently compiling material in reply to the employers. We have also lodged 11 applications to extend the term of zombie agreements that contain leave entitlements well in excess of the minimum provisions under the award. We want these terms preserved.

The industrial team has taken a leading role in bargaining for a national agreement for early childhood teachers and educators. In the schools sector, our work has focused on individual claims. We have been successful in obtaining low-range penalties for members in formal disciplinary processes and obtained substantial amounts of compensation for members who have been dismissed.
